Registering a trademark in Portugal is a straightforward process overseen by the National Institute of Industrial Property (INPI).
This process ensures your brand gains the legal protection it needs. Below is a step-by-step overview of how to secure your trademark:
Trademarks must be original and capable of distinguishing your goods or services from those of others. They should not be generic or descriptive to avoid misleading consumers. This distinctiveness is crucial in establishing the trademark’s identity and eligibility for protection.
Before filing your application, conducting a comprehensive search is essential to ensure that the trademark does not infringe on existing registered or pending marks in Portugal. This step is crucial to avoid potential legal challenges and rejections from the INPI.
The registration process begins with the application in the INPI. The application must include detailed information about the applicant, a clear representation of the mark, and the classification of goods or services (referred to as “classes”) that the trademark will cover.
Following the submission, the INPI examines the application for compliance with legal standards. If no issues are found, the trademark is then published in the official journal, opening up the floor for public scrutiny and potential challenges from third parties.
